[The Fact | Reporter Song Da-young and Kim Hae-in] Just before the Dec. 3 emergency martial law was declared, former Justice Minister Park Sung-jae showed an active attitude toward instructions, including taking notes of former President Yoon Suk Yeol's remarks on the declaration of martial law, according to the investigation team.
In summary, the special prosecutor team, Cho Eun-seok, who investigates the rebellion on the 12th, included the details in the indictment of former Minister Park on charges of obstructing the exercise of his right to abuse his authority and importance of rebellion.
Before the emergency martial law was declared on Dec. 3 last year, former Minister of Public Administration and Security Lee Sang-min, former Prime Minister Han Deok-soo, former National Intelligence Service Director Cho Tae-yong, former Unification Minister Kim Young-ho and former Foreign Minister Cho Tae-yeol at the Oval Office. Afterwards, Park, who came out of the Oval Office, took out two documents on emergency martial law from former President Yoon from the right inner pocket of his suit and checked the contents at 9:20 p.m.
Former President Yoon came out to the presidential office's hospitality room at 10:14 p.m. on the same day and spoke about the declaration of emergency martial law next to former Minister Park. The special prosecution team wrote on the indictment that former Minister Park was the only one of the six members of the State Council to take notes on the details of former President Yoon's remarks by taking the emergency martial law document out of his pocket again.
The independent counsel team judged that former Minister Park positively confirmed former President Yoon's martial law-related instructions. It was believed that he recognized that former President Yoon's declaration of emergency martial law did not meet the substantive requirements of the emergency martial law set by the Constitution and martial law.
On the previous day, the special prosecution team indicted former Minister Park without detention on charges of obstructing the exercise of the right to abuse authority, and violating the Unfair Solicitation Prohibition Act.
